Welcome to EventBit Studio("EventBit", "we", "our", or "us"). These Terms of Service ("Terms") govern your access to and use of EventBit Studio, including our website, applications, AI-powered photo search, event galleries, and related services available at https://eventbit.io.
By creating an account, accessing, or using our Services, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement.
2. Accounts
You may register using:
- Email OTP
- Phone OTP
- Google Sign-In
You are responsible for maintaining the security of your account and all activity under it.
3. Services
EventBit provides services including:
- Event photo gallery hosting
- AI Face Search
- Photo sharing
- Gallery management
- Photographer dashboards
- Client galleries
- Subscription management
- Image downloads
We may modify or discontinue features at any time.
4. Photographer Accounts
Photographers are responsible for:
- Uploading only content they own or have permission to upload.
- Obtaining all necessary permissions from clients.
- Maintaining the accuracy of account information.
- Paying subscription fees on time.
Photographers retain ownership of their photographs.
5. Client Accounts
Clients may:
- View galleries
- Upload selfies for AI Face Search
- Download photographs where permitted
- Create favorite lists
- Share galleries where enabled
Clients must not misuse the platform.
6. AI Face Search
EventBit uses AI technologies, including InsightFace, to help users locate photographs.
By uploading a selfie, you consent to the processing of your facial information for matching purposes.
Users may request deletion of their face profile at any time.
AI matching is probabilistic and may not always produce accurate results.
7. User Content
You retain ownership of the content you upload.
By uploading content, you grant EventBit a limited, non-exclusive license to host, process, display, and transmit your content solely for providing the Services.
8. Acceptable Use
You agree not to:
- Upload unlawful content.
- Infringe copyrights or trademarks.
- Upload malware or malicious code.
- Attempt unauthorized access.
- Reverse engineer the platform.
- Interfere with service availability.
- Use automated bots without authorization.
- Abuse AI Face Search.
9. Subscription & Billing
Subscriptions are managed through Chargebee and payments are processed using Razorpay.
Subscriptions may automatically renew unless cancelled before the renewal date.
Applicable taxes may be charged.
10. Failed Payments
If payment fails:
- Access to paid features may be restricted.
- Reminder notices may be sent.
- Galleries may become unavailable.
If payment remains overdue, uploaded galleries and photographs may be permanently deleted approximately 15 days after prior notices. Billing records may be retained as required by law.
11. Intellectual Property
The EventBit platform, software, branding, logos, and documentation are owned by EventBit or its licensors.
Nothing in these Terms transfers ownership of EventBit intellectual property.
12. Third-Party Services
EventBit integrates with third-party providers including:
- Chargebee
- Razorpay
- Backblaze B2
- Bunny.net
- Cloudflare
- Google OAuth
- WhatsApp / AiSensy
- Google Analytics
- Microsoft Clarity
- PostHog
- Sentry
- Brevo
Use of those services may also be subject to their own terms and privacy policies.
13. Service Availability
We strive to keep our Services available but do not guarantee uninterrupted or error-free operation.
Maintenance, updates, or events beyond our control may affect availability.
14. Disclaimer
The Services are provided on an "AS IS" and "AS AVAILABLE" basis.
To the maximum extent permitted by law, EventBit disclaims all warranties, express or implied.
15. Limitation of Liability
To the fullest extent permitted by law, EventBit shall not be liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, business interruption, or data loss.
16. Termination
We may suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or misuse the Services.
Users may close their accounts at any time.
17. Governing Law
These Terms are governed by the laws of India.
Courts located in Maharashtra, India, shall have exclusive jurisdiction unless otherwise required by applicable law.
18. Changes to These Terms
We may revise these Terms from time to time. Updated Terms become effective upon publication.
Continued use of the Services after changes constitutes acceptance of the revised Terms.
